TERMS & CONDITIONS FOR TESTING & REVIEWING FIVE POINT GRIPS FIREARMS GRIP PRODUCT

1. Introduction
Welcome, and thank you for your interest in testing our stick-on firearms grip product (the “Product”). By enrolling in this Test and Review Program (the “Program”) and accepting these Terms & Conditions (“T&Cs”), you (“Tester,” “you,” or “participant”) agree to comply with and be bound by the following:
1 You have read, understood, and agree to these T&Cs.
2 You represent that you meet all eligibility requirements outlined below.
3 You agree to follow any guidelines, rules, or instructions we provide in connection with your participation in the Program.
2. Eligibility
1 Age Requirement: You must be at least 21 years of age to participate in the Program.
2 Residency: You must be a legal resident of the United States.
3 Legal Authorization: You confirm that you can lawfully own or possess firearms in your jurisdiction. You assume responsibility for verifying and complying with all local, state, and federal firearm laws.
3. Participation in the Program
1 Application & Selection: Submission of an application does not guarantee acceptance. We reserve the right to select or decline any applicant at our sole discretion.
2 Product Provision: If selected, you will receive one (1) unit of the Product for testing and review purposes. We will cover the cost of the Product and standard shipping, with no additional fees charged to you.
3 Testing Period: You agree to use the Product as intended for a period of 2–4 weeks and to provide honest, detailed feedback via surveys or other means as requested.
4 Feedback & Reviews: You agree to provide feedback that may include written responses, photographs, or video reviews of your experience using the Product. All feedback must reflect your genuine opinion based on personal experience.
4. User Conduct & Responsibilities
1 Proper Use: You agree to follow all safety guidelines, instructions, and any applicable laws or regulations governing firearms and accessories. Installation must follow the instructions provided with the Product (e.g., ensuring the firearm’s surface is clean and dry before application).
2 Firearm Safety: The Product is not a substitute for firearm safety training or safe handling practices. You acknowledge that proper firearm safety training and adherence to safety guidelines are your sole responsibility.
3 Lawful Use Only: You agree not to use the Product for any unlawful activity. You assume full responsibility for any consequences arising from misuse or non-compliance with local, state, and federal laws.
4 No Modification: You shall not modify, reverse-engineer, or otherwise alter the Product, except as specifically permitted by our instructions.
5. Ownership & Intellectual Property
1 Product Ownership: The Product becomes your property upon delivery; you are not required to return it after the testing period unless otherwise specified in Section 10.2 (Early Termination).
2 Feedback License: By submitting any written, photographic, or video feedback, you grant Five Point Grips, llc a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, and display such feedback for marketing, promotional, and product development purposes. This includes reposting or sharing your user-generated content on social channels or websites.
3 Trademarks & Copyright: All trademarks, logos, and service marks displayed on the Product or in related materials are the property of Five Point Grips, llc or third parties. Unauthorized use is strictly prohibited.
6. Confidentiality & Publicity
1 Confidential Information: Certain features or details of the Product may be confidential if the Product is not yet publicly released. You agree not to disclose any confidential information, including technical specifications or design details not publicly announced by Five Point Grips, llc.
2 Public Reviews: There is no embargo period. You may post public reviews, including photos or videos, after receiving the Product and having adequate time to test it. All public statements must reflect your genuine and honest opinions.
3 Social Media Sharing: You are free to mention brand names and tag our company in social media posts about the Product, provided it does not breach these T&Cs or disclose confidential information.
7. Disclaimers
1 No Warranty for Testing: The Product is provided “AS IS” for testing purposes. Five Point Grips, llc makes no representations or warranties of any kind, either express or implied, including fitness for a particular purpose, merchantability, or non-infringement, to the extent permitted by law.
2 Safety Disclaimer: Firearms are inherently dangerous. By participating, you acknowledge and assume all risks associated with firearms use, including the use of aftermarket accessories.
3 Compliance with Local Laws: It is your responsibility to ensure that you are in compliance with all applicable laws regarding the possession and use of firearm accessories.
4 Proposition 65 (California Residents): Warning: This Product may contain chemicals known to the State of California to cause cancer, birth defects, or other reproductive harm.
8. Limitation of Liability
1 Assumption of Risk: You understand that testing the Product involves inherent risks, including those related to firearm use. You voluntarily assume full responsibility for any injuries or damages that result.
2 Limitation: In no event shall Five Point Grips, llc or its affiliates be liable for any incidental, special, consequential, or punitive damages, whether arising in contract, tort, or otherwise, related to your participation in the Program, except to the extent prohibited by applicable law.
3 Indemnification: You agree to indemnify and hold harmless Five Point Grips, llc, its officers, directors, employees, and agents from any claims arising out of your use of the Product, your breach of these T&Cs, or any violation of law.
9. Privacy & Data Protection
1 Data Collection: We will collect and store the personal information you provide, such as name, address, and contact details, solely for Program administration.
2 Data Usage: We may use your personal information to coordinate shipping, conduct follow-up surveys, and send you updates about the Program.
3 No Third-Party Sharing: We do not share your information with third-party fulfillment providers or any other third parties.
4 Opt-Out: You may opt out of marketing communications at any time, but may still receive essential administrative messages regarding the Program.
10. Program Modification & Termination
1 Modifications: We reserve the right to modify or terminate the Program at any time, for any reason, without prior notice.
2 Early Termination & Return: We may revoke your participation if you breach these T&Cs or if we suspect fraudulent, abusive, or unlawful activity. In such cases, we reserve the right to request the return of the Product at our discretion and at our cost (e.g., we may provide you with a prepaid shipping label).
11. Governing Law & Dispute Resolution
1 Governing Law: These T&Cs shall be governed by and construed in accordance with the laws of the United States of America and the State of Michigan, without regard to conflict-of-law principles.
2 Dispute Resolution: Any dispute arising out of these T&Cs shall be resolved in accordance with the laws of the State of Michigan. You consent to the personal jurisdiction of the state and federal courts located in Michigan for the resolution of any disputes.
3 Severability: If any provision in these T&Cs is deemed unenforceable, all other provisions shall remain in effect.
12. Acceptance of Terms
By checking the box or clicking “I Agree” (or similar) during the signup process or by participating in the Program, you acknowledge that you have read, understood, and agree to be bound by these T&Cs. If you do not agree, you must not participate in the Program.
